Welcome to the Terms of Service (the “Terms”) for Elysium Jet, L.L.C. (for purposes of these Terms, “Elysium”, “we”, “our”, and “us”). Please read on to learn the rules and restrictions that govern your use of our informational website and all our Applications that reference these Terms (an “App” or “Apps”) (collectively, the “Services”). These Terms govern your use of the Services and provide information about the Services. Your use of the Services in any way means that you agree to all of these Terms. These Terms will remain in effect for so long as you access our Services, use or retain any content from our Services, and until any disputes arising from such use, access, or retention receive final resolution. These Terms include the provisions in this document as well as those in the Privacy Policy. Your use of the Services may be subject to additional policies, rules, instructions, and/or conditions (“Additional Terms”) such as membership or jet card programs that will be displayed or linked to when the applicable service is accessed and which are incorporated herein by reference. You understand and agree that by using the Services, you also agree to comply with these Additional Terms. To the extent that any Additional Terms conflict with these Terms, the Additional Terms will control.
These Terms are written in English. Translations may be provided for convenience, but in case of conflict, the English version governs.
The headings are included for convenience only and do not affect the interpretation of these Terms.
Your use of and access to our Services is subject to these Terms. If you do not agree to all of these Terms, you may not use or access the Services.
Elysium provides a global private jet charter and concierge service. Through our network of preferred charter aircraft providers, we provide customers the ability to fly privately to nearly anywhere they wish. Through the Services, you can request on-demand charters, sign up for membership programs, or purchase jet card offerings. Additional Terms may apply depending on the offering selected.
When you book a flight through us, you will enter into an agreement with the flight provider. Flights are operated by independent charter providers in our network, not by Elysium, and providers may require you to accept their own terms. We are not a party to agreements between you and any such provider; any recourse is solely against the provider.
Elysium may also offer additional services such as car reservations or deliveries. Performance of these services is subject to the provider’s terms.
We may update these Terms at any time. Notices will be posted on our website, emailed, or otherwise provided. Continued use of the Services after changes indicates acceptance.
Except for changes made by us, no other modification is effective unless in writing and signed by both parties.

We do not knowingly collect information from children under 13. If you are under 13, do not attempt to use our Services. Any such attempt is a violation of these Terms. Contact us at booking@elysiumjet.com if you believe a child under 13 provided information.
You must be of legal age to form a binding contract. If agreeing on behalf of an organization, you confirm authority to bind it. You may only use the Services in compliance with applicable law.
You may create an account to access features. Keep your account and password secure. You are responsible for all activities under your account. Notify us immediately of unauthorized use.
By providing your mobile number and opting in to receive text messages from Elysium Jet, LLC (“Elysium Jet”), you consent to receive SMS communications related to your relationship with Elysium Jet. These may include booking confirmations, flight updates, membership information, promotional offers, and customer service messages.
Message frequency may vary depending on your interaction with our services, but typically does not exceed two (2) messages per week.
Message and data rates may apply according to your mobile carrier and plan.
Text HELP to the number that sent you the message for assistance, or contact booking@elysiumjet.com.
You may opt out at any time by texting STOP to the same number. Upon receipt, you will receive a one-time confirmation message, and you will no longer receive SMS messages from Elysium Jet.
We value your privacy. Please review our Privacy Policy to understand how your personal data is collected and used.
You may receive messages from Elysium through the Services (email or SMS).
You agree not to:
You retain ownership of your content. Elysium may quote or reproduce public content to promote Services. We may remove content violating these Terms. You are responsible for evaluating content and assume associated risks.
Content on the Services is protected by copyright and intellectual property laws. Users may only use content as permitted by these Terms. Unauthorized use is prohibited.
YOU WAIVE AND HOLD HARMLESS ELYSIUM FROM ANY CLAIMS ARISING FROM ACTIONS TAKEN DURING INVESTIGATIONS OR ENFORCEMENT.
You access content at your own risk. Elysium is not responsible for errors, omissions, or third-party interactions. Disputes between users are your responsibility; Elysium is not liable.
Services may change over time. We may limit, suspend, or remove parts of Services, with or without notice.
Use of Services is free, but we may charge fees in the future for certain functionalities.
You may stop using Services at any time. Elysium may terminate or suspend access for violations. Certain obligations, including payment, intellectual property, and dispute resolution, survive termination.
All payments are processed via third parties, currently Paynode (Currencycloud Limited).
SERVICES AND CONTENT ARE PROVIDED “AS-IS.” ELYSIUM AND ITS PARTNERS MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR PURPOSE, OR NON-INFRINGEMENT.
TO THE FULLEST EXTENT ALLOWED BY LAW, ELYSIUM AND ITS PARTNERS ARE NOT LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR AMOUNTS EXCEEDING THE LESSER OF $100 OR AMOUNTS PAID IN THE PRECEDING 12 MONTHS.
You agree to indemnify Elysium and its partners for claims, losses, or expenses arising from your use of Services or violation of these Terms.
You may not assign these Terms without Elysium’s written consent. Elysium may assign without your consent.
These Terms are governed by Delaware law and the Federal Arbitration Act.
All disputes will be resolved by binding arbitration in Delaware. Small claims may be filed locally. Parties waive jury trial and class actions. Opt-out is available by written notice to 169 Madison Ave STE 11701, New York, NY 10016within 30 days of acceptance.
You are responsible for taxes. These Terms are the complete agreement between you and Elysium. You are not an employee or agent of Elysium. There are no third-party beneficiaries.

Information on Services is for general purposes only. Any reliance is at your own risk.
